The first provision enforced was that the state has to approve the form of gaming that is conducted. The second provision was the state and reservations had to agree on where to build each casino. The third provision required the tribe to develop gaming ordinances to be approved by the chairman of the National Indian Gaming Commission. Native American gaming comprises casinos, bingo halls, and other gambling operations on Indian reservations or other tribal lands in the United States. Because these areas have tribal sovereignty, states have limited ability to forbid gambling there, as codified by the Indian Gaming Regulatory Act of 1988. As of 2011, there were 460 gambling operations run by 240 tribes, with a total annual revenue of $27 billion. In that sense, Native Americans need to abide by federal and state laws, while other regulations do not apply for them.

Of course, if you look at rooms or overall square footage, the other two instantly dwarf the WinStar, but when it comes to pure gambling action, the Winstar reigns supreme. Witnesses whose depositions are taken as authorized in this section, and the persons taking the same, shall severally be entitled to the same fees as are paid for like services in the courts of the United States. Decisions made by the Commission pursuant to sections 2710, 2711, 2712, and 2713 of this title shall be final agency decisions for purposes of appeal to the appropriate Federal district court pursuant to chapter 7 of title 5. The Commission shall require a potential contractor to pay a fee to cover the cost of the investigation necessary to reach a determination required in subsection of this section. The Chairman, after notice and hearing, shall have the authority to require appropriate contract modifications or may void any contract if he subsequently determines that any of the provisions of this section have been violated. For grounds and mechanisms for terminating such contract, but actual contract termination shall not require the approval of the Commission.
